Terms of Use
Last updated: June 16, 2026
These Terms of Use ("Terms") are a binding agreement between you and Gemxmax. They cover the website, your account, deposits, withdrawals, rewards, and trading on prediction markets.
Creating an account, placing a trade, or continuing to use the service means you accept these Terms and the Privacy Policy. If you do not agree, do not use the platform.
1. Eligibility
You may use the platform only if every condition in this section is true. We can refuse or end access where the law, sanctions, or our risk rules require it.
1.1 Age and capacity
- Minimum age: You must be at least 18, or the age of majority where you live, whichever is higher.
- Capacity: You must be able to enter a binding contract in your own name.
- Your own use: You use the service for yourself. You may not open or run an account for a minor or for someone who is not allowed to use it.
1.2 Where you can use the service
- Local law: You are responsible for making sure prediction markets are lawful where you are.
- Restricted places: We may block countries, regions, or networks at any time.
- No circumvention: A VPN, proxy, or false address used to bypass a block breaks these Terms.
1.3 Who cannot join
- Sanctions: You may not use the service if you, or a person who owns or controls you, are on a sanctions list.
- Prior bans: You may not open a new account after we closed one for a rules breach.
- Partner rules: Payment and compliance partners can exclude additional persons. We apply those limits.
2. Your account
Your account is personal. You keep the details accurate, you keep the login private, and you are responsible for what happens after you sign in.
2.1 Registration and profile
- Accurate details: Give current information at sign-up and update it when it changes.
- One person: Do not keep extra accounts to dodge limits, bans, or promotion rules unless we say so in writing.
- Activity on the account: Trades, messages, and balance changes made while signed in are treated as yours.
2.2 Password and security
- Keep the password private: Do not share it with anyone, including support.
- Tell us quickly: If you think someone else has access, contact support chat immediately.
- What we never ask: We will not ask for your password, private keys, or recovery phrase in chat.
3. Verification and compliance
Verification is part of the rules, not an optional extra. Using the service means you will complete identity and compliance checks when we ask.
3.1 When we ask you to verify
- Larger deposits: Before or while a deposit crosses a platform threshold.
- Withdrawals: Before a payout, especially the first one or a larger amount.
- Trading checks: When a bet triggers risk, compliance, or anti-fraud rules.
- Any time: When the law, a payment partner, or our policy requires it.
3.2 How verification works
- Steps on screen: Confirm your profile and finish the checks shown in the app or in support chat.
- Case by case: Follow the instructions we send. Delays on your side keep limits in place.
- Truthful answers: False, incomplete, or misleading information breaks these Terms.
3.3 If verification is not finished
- Features can pause: Deposits, bets, withdrawals, or rewards may stay blocked until the check is done.
- Funds can wait: Balances may remain on hold during review. We do not have to pay out an unverified or high-risk account.
- Refusal: Repeated failure or refusal can lead to restriction or closure.
4. Platform services
Gemxmax lets you view event markets and take positions on outcomes. Features can be added, changed, or removed.
4.1 What the platform includes
- Markets: Questions about real-world events, with the outcomes shown on each market.
- Account tools: Balance, deposits, withdrawals, bets, rewards, and support chat.
- Listings change: Categories, featured markets, and labels can change without a separate notice.
4.2 Availability
- No uptime promise: Maintenance, outages, and third-party failures can interrupt the service.
- Delays: Prices, volumes, and stats are for use on the platform and can lag or be rounded.
- Feature removal: We may discontinue a market, a category, or a tool when we need to.
5. Trading and markets
A trade is a position on a stated outcome. You can lose the stake. Read the market rules before you confirm.
5.1 How a market works
- The question: Each market states a real-world event and the outcomes you can choose.
- The price: It reflects an implied chance and can move before you confirm.
- Your confirmation: A position is open only after the app accepts it. A quote on screen is not a fill.
- Resolution: When the event settles, open positions follow the rules published on that market.
5.2 Risk
- You can lose the stake: The amount you put on a position can go to zero.
- Money you can spare: Do not trade funds you need for living costs.
- No advice: We do not give investment, legal, or tax advice. Past results do not predict later ones.
- Your decision: You choose the market, the side, and the size.
5.3 Settlement and corrections
- Winners: A winning position is credited after resolution, minus any fee shown before you confirmed.
- Losers: A losing position forfeits the stake unless the market is cancelled.
- Corrections: We may void, cancel, reverse, or adjust a trade or a market for a clear error, fraud, manipulation, a technical failure, or a legal requirement.
- Final call: Our reading of the published market rules is final, except where the law says otherwise.
6. Deposits, withdrawals, and balances
Money moves only through the methods shown in your account. Wrong network, wrong asset, or wrong address can be lost.
6.1 Deposits
- Use the address on screen: Send only the asset and network shown for that deposit.
- When it credits: The balance updates after the required confirmations and any minimum amount.
- We can refuse one: Deposits tied to fraud, sanctions, or a rules breach can be rejected or reversed.
6.2 Withdrawals
- Review first: Payouts can be checked, limited, and delayed.
- We can decline: Suspicious, incomplete, or unverified withdrawals can be held or refused.
- Your payout details: You are responsible for the address, network, and account you enter.
- Fees: Any withdrawal fee is shown before you confirm. Network fees charged by the chain are separate.
6.3 Promotional balances
- Extra conditions: Bonus, referral, and promo credit can require wagering or other steps shown with the offer.
- Not the same as cash: A promo balance can be unusable for withdrawal until those steps are done.
- Clawback: We can change, expire, or take back promo credit that came from abuse or an error.
7. Rewards and referrals
Missions, referrals, and promos are optional programs. They can change or end, and they never override these Terms.
7.1 How programs work
- Offered at our discretion: A mission, gift, or referral rate can be changed or stopped.
- Shown conditions: You receive a reward only when the conditions on that offer are met.
- One reward path: Unless the offer says otherwise, the same action does not pay twice.
7.2 What disqualifies a reward
- Self-dealing: Referring yourself, or moving money between your own accounts, does not count.
- Fake activity: Duplicate accounts, circular deposits, and scripted volume can be removed.
- Reversal: Rewards tied to prohibited conduct can be withheld or taken back.
8. Prohibited conduct
The activities below are forbidden. A breach can lead to the actions in the enforcement section.
8.1 Market and trading abuse
- Manipulation: Wash trading, spoofing, or coordinated activity meant to mislead a price.
- Inside information: Trading on material non-public information.
- Automation: Bots, scripts, or other automated trading without our written permission.
8.2 Account abuse
- Extra accounts: More than one account per person to evade a limit, a bonus rule, or a ban.
- False identity: Pretending to be someone else, or using another person’s account.
- Bypassing controls: Dodging a region block, a security check, or verification.
8.3 Financial crime and harm to the platform
- Illicit funds: Money laundering, fraud, stolen assets, or chargeback abuse.
- Abuse of people: Harassment of staff or users, or malicious files in support.
- Attacks: Scraping, reverse engineering, or anything that degrades stability or security.
9. Rule violations and enforcement
We watch for breaches of these Terms, market rules, and applicable law. Enforcement protects the platform and other users.
9.1 Actions we may take
- A warning: We can ask for an explanation or for more verification in support chat.
- Limits: Deposits, betting, withdrawals, or rewards can be paused for a time or for good.
- Reversals: Trades, bonuses, and promo credit from abuse can be cancelled.
- A hold: Balances can be frozen while we investigate.
- Closure: The account can be closed, and future access refused.
9.2 Action without advance notice
We can act immediately when we reasonably believe an account creates fraud risk, legal exposure, or harm to other users.
- Examples: Suspected multi-accounting, market manipulation, or a sanctions issue.
- Why no warning: A delay can let funds move or let the harm continue.
- Afterward: You can still write to support chat and ask for a review.
9.3 Questions and appeals
- How to ask: Contact support chat with your registered email and a clear explanation.
- What we review: Good-faith appeals are read. We do not have to restore an account when the breach is substantiated.
- Point to the rule: Mention the relevant section, such as verification limits or enforcement actions, so we can find the case.
10. Intellectual property
The platform, the name, the software, and the content we publish belong to us or our licensors.
10.1 What you are allowed to do
- Personal use: A limited, revocable license to use the service for your own lawful activity.
- No resale: You may not copy, resell, or commercially exploit the product, data, or branding without permission.
- Your content: You keep ownership of text you send to support, and you let us use it to run and protect the service.
11. Privacy
Personal information is handled under the Privacy Policy. Using the platform means you have read that policy.
11.1 How these documents fit
- Privacy Policy: What we collect, why we use it, and the choices you have.
- These Terms: The rules for the account, trading, money, and enforcement.
- If they differ: A specific rule on a market or an offer controls that market or offer. These Terms still apply to everything else.
12. Disclaimers
The service is a platform for event markets. It is not a promise that a position will win or that the site will be free of errors.
12.1 As-is service
- No warranty: The service is provided "as is" and "as available", without warranties of any kind, express or implied.
- Errors: We do not warrant that markets, prices, or settlement will be uninterrupted or free of mistakes.
- Third parties: Blockchains, wallets, and data sources can fail. We are not responsible for their outages.
13. Limitation of liability
To the maximum extent permitted by law, our liability is limited as follows.
13.1 Damages we do not cover
- Indirect loss: We and our affiliates, officers, and partners are not liable for indirect, incidental, special, consequential, or punitive damages.
- Lost profit: That exclusion includes lost profits, data, and goodwill.
- Typical causes: Market moves, your own mistake, a network issue, or a third-party service.
13.2 Cap on direct claims
- The ceiling: Our total liability for a claim about the service will not exceed the greater of the fees you paid us in the three months before the claim, or one hundred U.S. dollars.
- Where the law forbids a cap: This limit does not apply to the extent a statute says it cannot.
14. Indemnification
You will cover Gemxmax and its affiliates for claims that come from how you use the platform.
14.1 What you cover
- Your use: Claims, damages, and reasonable legal fees arising from your activity on the service.
- A breach: The same applies if you violate these Terms or infringe someone else’s rights.
- Our conduct of the defense: We may control the defense of a claim that you have agreed to cover. You will cooperate.
15. Suspension and termination
You can stop using the platform. We can suspend or close an account that breaks the rules or creates a legal or security risk.
15.1 Closing your account
- You may leave: Stop using the service at any time.
- Remaining balance: A payout still follows verification, review, and withdrawal rules.
- Open positions: Close or wait for settlement before you expect a full withdrawal.
15.2 Closure by us
- Reasons: A rules breach, failed verification, or a legal or security risk.
- Promo credit: Closure does not require us to pay promotional balances that were obtained improperly.
- Access afterward: A closed account may not be reopened, and a replacement account may be refused.
15.3 What still applies after closure
Liability, indemnification, disputes, and enforcement still apply after the account is closed, where the law allows.
16. Disputes
Start with support chat. Many issues are fixed there without a formal claim.
16.1 Contact us first
- Write in support chat: Describe what happened, the market or the payment, and the amount.
- Use your account email: That is how we match the request to you.
- Give us time: We need a fair chance to look at the records before you escalate.
16.2 Governing law
- Which law: These Terms are governed by the law we designate for the entity that serves your account, without conflict-of-law rules.
- Mandatory rights: Consumer protections that cannot be waived in your country still apply.
17. Changes to these Terms
We can update these Terms. The date at the top of this page changes when we do.
17.1 How an update works
- Posted here: Material changes appear on this page with a new date.
- Continued use: Using the platform after the change takes effect means you accept it, unless the law requires a different form of consent.
- If you disagree: Stop using the service before the change applies, and withdraw any balance under the withdrawal rules.
18. Contact
Questions about these Terms go through support chat.
18.1 What to send
- Your email: The address on the account.
- The topic: Say whether it is an account, a trade, a deposit, a withdrawal, or these Terms.
- The facts: Include dates, amounts, and any transaction id you have. Do not send passwords or recovery phrases.
